Hatch & Hive Vendor Terms

1. Introduction

These Vendor Terms govern participation in the Hatch & Hive marketplace operated by Hatch & Hive ("the Platform", "we", "us", "our").

By registering as a vendor, you agree to comply with these Terms, our Privacy Policy, and all applicable laws and regulations.

2. Vendor Eligibility

Vendors must:

Be at least 18 years old.
Be legally entitled to sell the products they list.
Provide accurate registration and contact information.
Maintain current contact details at all times.

We reserve the right to request identification or additional verification documents.

3. Vendor Responsibility

Vendors are solely responsible for:

The accuracy of listings.
The quality, health, condition, and legality of products offered.
Compliance with all applicable animal welfare, trading, transport, and consumer protection laws.
Fulfilling orders and responding to customer enquiries.

Hatch & Hive acts solely as a marketplace and is not a party to transactions between buyers and vendors.

4. Permitted Products

Vendors may only list products that fall within approved marketplace categories, including:

Hatching eggs
Poultry
Chicks and ducklings
Waterfowl
Beekeeping products
Poultry housing and related equipment

We reserve the right to remove listings that are:

Misleading
Illegal
Unsafe
In breach of animal welfare standards
Inconsistent with the values of the marketplace

5. Animal Welfare

Vendors must ensure:

Animals are kept and transported in accordance with UK legislation.
Listings accurately describe age, breed, health status, and condition.
Any required licences, registrations, or permits are maintained.

Any vendor found breaching welfare standards may be removed immediately.

6. Listing Standards

All listings must:

Use genuine photographs.
Include accurate descriptions.
Clearly state pricing.
Accurately disclose collection, delivery, or shipping arrangements.

False, misleading, or deceptive listings may be removed without notice.

7. Sales and Payments

Vendors are responsible for:

Processing and fulfilling orders.
Managing customer communications.
Handling refunds where required by law.
Paying any applicable taxes.

Hatch & Hive may charge commission, subscription fees, or other marketplace fees as published from time to time.

8. Disputes

Vendors agree to make reasonable efforts to resolve disputes directly with buyers.

Where a dispute arises, Hatch & Hive may:

Request information from either party.
Temporarily suspend listings.
Restrict account access while investigating.

Our decision regarding marketplace participation is final.

9. Prohibited Conduct

Vendors must not:

Circumvent marketplace fees.
Manipulate reviews or ratings.
Harass buyers or other vendors.
List prohibited products.
Provide false information.
Engage in fraudulent activity.

10. Account Suspension

We may suspend or terminate a vendor account where:

These Terms are breached.
Complaints indicate serious misconduct.
Animal welfare concerns arise.
Legal or regulatory concerns exist.

Suspension may occur without prior notice where necessary.

11. Limitation of Liability

Hatch & Hive provides an online marketplace only.

We do not guarantee:

Product quality.
Fertility rates of hatching eggs.
Animal health outcomes.
Delivery performance.
Buyer conduct.

To the fullest extent permitted by law, Hatch & Hive shall not be liable for losses arising from transactions between buyers and vendors.

12. Indemnity

Vendors agree to indemnify and hold harmless Hatch & Hive against claims, losses, liabilities, costs, and expenses arising from:

Their listings.
Products sold.
Breach of these Terms.
Breach of applicable law.

13. Changes to Terms

We may amend these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
